Erla Muni Mangaiah, v. The State Of Andhra Pradesh,

2018-02-27A Ramalingeswara Rao2 pages

THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6405 of 2018 ORDER:

This Writ Petition is filed challenging the action of the fourth respondent in failing to consider the proceedings of respondent Nos.2 and 3 in directing him to consider the legal notice issued on behalf of the petitioners dated 06.04.2015 and 28.05.2015 for rectification of entries under the Andhra Pradesh Rights in Land and Pattadar Pass Books Act.

The grievance of the petitioners is that the notices issued by their Counsel on 06.04.2015 and 28.05.2015 were not considered and no action was taken in spite of the proceedings of respondent Nos.2 and 3 dated 09.07.2015 and 12.06.2015 for rectifying the entries in the revenue records. But, as per the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, the petitioners have to make a proper application for such relief and in the absence of any application, no relief can be granted in the present Writ Petition. In the circumstances, the petitioners are given liberty to make proper application under the Andhra Pradesh Rights in Land and Pattadar Pass Books Act. As and when such application is filed, the fourth respondent shall consider the same and pass appropriate orders, within a period of four weeks thereafter.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 27.02.2018 vs
