HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44446 of 2016 ORDER:
This writ petition is filed seeking a direction to the 3rd respondent not to interfere with the civil disputes between the petitioner and respondents 4 & 5 in respect of shop (mulgie) in Plot No.55, H.No.1-59/65, Ground Floor, road side at Miyapur, Serilingampally Mandal, R.R.District.
Heard and perused the material available on record. The grievance of the petitioner is that without there being any complaint, the 3rd respondent at the instance of respondents 4 & 5 herein is compelling the petitioner to execute documents and to vacate the shop in Plot No.55, H.No.1-59/65, Ground Floor, road side at Miyapur, Serilingampally Mandal, R.R.District. Learned Assistant Government Pleader for Home submitted that the 3rd respondent is not intending to interfere with the civil disputes between the petitioner and the unofficial respondents. Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of directing the 3rd respondent not to interfere with the civil dispute between the petitioner and the unofficial respondents. However, this order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioner disclosing cognizable offence. No costs.
