This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner/accused No.2 in Crime No.15 of 2026 of CCS,EOW Team-V, Detective Division, CCS, Hyderabad, registered for the offence punishable under Section 318 (4) read with 3 (5) of the BNS.

The case of the prosecution is that the de facto complainant lodged a report before police on 31.01.2026, wherein it is stated that he along with his friend has come in contract with the A.1. A.1 became close friend and started approaching them frequently and calling for lunch, dinner etc. Believing A.1, the complainant invested huge amount with A.1. Later L.Ws.1 and 2 also invested Rs.55,00,000/- each through each, cheque, RTGS and UPI to M/s. Akkala Imports and Exports, represented by A.1. Thereafter A.1 gave cheque Rs.10,00,000/- each to LWs.1 and 2, which were dishonoured. When L.Ws.1 and 2 insisted for amount, the said company giving evasive replies. Hence, he lodged a complaint to take necessary action against the accused persons. Basing on the same, police registered a case for the aforesaid offences. 4.
Learned counsel for the petitioner-A.2 would submit that L.Ws.1 and 2 transferred amount huge amount and subsequently the A.2 diverted the said amount from company account into his personal accounts.
He further submits that petitioner/A.2 stood as a witness at the time when A.3 issued cheques and executed a written promise letter in his own handwriting. As such, petitioner is arrayed as A.2. The petitioner is no way connected with the alleged crime and there is no contract between the petitioner and the de facto complainant. Even according to the complainant, there is no nexus between himself and the petitioner expect saying that some amounts are transferred to A.1. Petitioner is no way connected with the said agreement and he is ready to cooperate with the investigation and hence, he prays to granted anticipatory bail to him.

On the other hand, learned Additional Public Prosecutor opposed the same and contended that as the petitioner herein is involved along with A.1 and other accused, custodial interrogation is required in this case and at this stage, the petitioner is not entitled for grant for bail and hence, he prays to dismiss the petition. 6.
Having regard to the submissions made by both the parties and on perusal of the material on record shows that the punishment prescribed for the offences alleged
against the petitioner is below seven years, this Court is inclined to grant Anticipatory bail to the petitioner subject to the following conditions:
(i) The petitioner shall surrender before the learned XII Additional Chief Judicial Magistrate, Hyderabad, within two (2) weeks from today, and on such surrender, the petitioners shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each.
(ii) After release, the petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required. (iii) The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
