THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.1969 of 2022 ORDER:

This Criminal Petition under Sections 437 and 439 Criminal Procedure Code are filed by petitioner, who is arrayed as accused No.8 in Crime No.4 of 2022 of Gangadhara Police Station, Karimnagar, registered for the offences punishable under Sections 143, 120, 120-B r/w.149 of Indian Penal Code and Section of Explosives Substances Act, 1908 and Section Sectoin 10, 13, 16, 18, 18 (B) of Unlawful Activities Prevention Amendment Act, 2019 seeking bail.

Briefly stated the case of the prosecution is that, on 10.01.2022 a suo motu case was registered against Accused No.1 and seized explosive material from accused No.1. During the course of further investigation it was found that Accused No.8 was in contact with Accused No.1 on whatsapp.

Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor for the State-respondent and perused the record.

The learned Counsel for the petitioner submits that other than the evidence of some communication of whatsapp with

Accused No.1 there is no evidence to show that Accused No.8 was involved in any act attracting penal consequences nor any recoveries were effected which is not disputed by the learned Assistant Public Prosecutor. Further, Accused No.3 was granted bail on 25.03.2022 by the IX Additional Sessions Judge, Siricialla vide Criminal M.P.No.57 of 2022.

In view of the fact that other than the confession of accused No.1, there being no seizure or any overt acts attributed to Accused No.8, he can be released on bail.

Accordingly, the Criminal Petition is allowed, directing the petitioner to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a lime sum each to the satisfaction of Judicial Magistrate of First Class, Vemulavada. Further, on such release, the petitioner shall appear before the Station House Officer, Gangadhara on every Sunday between 10.00 a.m and 12 Noon for a period of three months or till filing of charge sheet, whichever is earlier.
