THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35256 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 3 to 7 in interfering with the peaceful possession and enjoyment over the petitioner's open house plot in survey No.240 of Enumamula Village, Warangal Urban Mandal, Warangal Urban District, admeasuring Acs.285.50 square yards at the instigation of respondents 8 to 10 as illegal and arbitrary and consequently to direct respondents 3 to 7 not to interfere with the peaceful possession and enjoyment of the open house plot of the petitioner.

Heard and perused the material.

Learned counsel for the petitioner submits that the respondents 3 to 7 are interfering with the peaceful possession and enjoyment over the petitioner's open house plot in survey No.240 of Enumamula Village, Warangal Urban Mandal, Warangal Urban District, admeasuring Acs.285.50 square yards at the instigation of respondents 8 to 10 and as such, he prays this Court to direct respondents 3 to 7 not to interfere with the peaceful possession and enjoyment of the open house plot of the petitioner.

Learned Assistant Government Pleader for Home (Telangana) submits that the respondents 3 to 7 are not interfering with the peaceful possession and enjoyment of the petitioner over his subject property. Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the respondents 3 to 7 not to interfere the peaceful possession and enjoyment over the petitioner's open house plot in survey No.240 of Enumamula Village, Warangal

Urban Mandal, Warangal Urban District, admeasuring Acs.285.50 square yards at the instigation of respondents 8 to 10 and respondents 3 to 7 are directed to follow the due process of law laid down in Code of Criminal Procedure.
