This Writ Petition is filed for a Mandamus to declare the action of respondent Nos.2 to 10 in erecting the BSNL Mobile Cell Tower in front of the land admeasuring Acs.4-00 in Survey Nos.486/2 and 487 of Sirsa Village, Kotapally Mandal, Adilabad District, which was allotted for construction of a school building, as illegal. The petitioners sought for a consequential direction to the respondents to remove the structures raised for installation of the BSNL cell tower.

As the petitioners failed to implead the Gram Panchayat, which, being a body corporate, is liable to be sued or entitled to sue, the Writ Petition is dismissed, however, with liberty to the petitioner to file a fresh Writ Petition.

As a sequel to dismissal of the Writ Petition, WPMP.No.54370 of 2015, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________
