THE HON'BLE SRI JUSTICE K.C.BHANU AND THE HON'BLE MRS JUSTICE ANIS WRIT PETITION No.16987 OF 2015 ORDER:- (per Hon'ble Sri Justice K.C.Bhanu) This writ petition is filed challenging the order, dated 2.4.2013, in O.A.No.850 of 2011 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, "the Tribunal").

2. Respondent No.1/applicant filed the aforementioned Original Application before the Tribunal to call for the records relating to proceedings RC.No.Ser-I-2/1400/2009, dated 12.2.2011, issued by petitioner No.1 herein and quash the same insofar as promotion of respondent No.3 is concerned and further, to direct the petitioners herein to consider his case for promotion to the post of Principal by following rule of reservation for Scheduled Tribes with all consequential benefits.

3. The Tribunal, upon considering the material on record, disposed of the aforementioned Original Application directing the petitioners herein to consider the case of the applicant for promotion to the post of Principal, Junior College at 83rd point for ST category and pass appropriate orders within a period of four weeks from the date of receipt of a copy of that order. Aggrieved thereby, Government filed the present writ petition.

4. Learned Government Pleader for Services - I (Andhra Pradesh State) appearing for the petitioners herein contended that adequacy has been achieved in giving promotion to the Scheduled Tribe candidates to the posts of Principals and

therefore, the case of the applicant is not entitled to be considered for promotion to the post of Principal and hence, he prays to set aside the impugned order.

5. Vide impugned order, no positive direction was given to the petitioners herein by the Tribunal. The direction was to consider the case of respondent No.1/applicant for promotion and pass appropriate orders within a period of four weeks from the date of receipt of a copy of that order. Therefore, considering the contentions raised by the learned Government Pleader, the petitioners are directed to take appropriate decision and pass orders in accordance with law.

6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Since no adverse order is passed against the respondents herein, notice to the respondents in the writ petition is not necessary.
