Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for respondents. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed with the following prayer:

"to issue an appropriate Writ, Direction or Order more in the nature of Writ of Mandamus declaring the action of Respondent No.2 in not implementing the orders passed by Respondent No.3 dated 09.12.2015 in Appeal No.

E/1550/2015, as illegal arbitrary and violative of Article 14 of Constitution of India."

Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the 2nd respondent to implement the order passed by the 3rd respondent dated 09.12.2015.

Learned Government Pleader for Revenue submits that he has no objection for the same, if not implemented till date. 5.

It is to be noted that the 3rd respondent - the Revenue Divisional Officer, Kakinada, by his order dated 09.12.2015, directed the 2nd respondent to conduct survey in the property in dispute, consider the request of the applicants therein and also rectify the

CPK,J WP_36558_2016 entries in 1B Register. As contended by the learned counsel for the petitioners, till date no steps have been taken pursuant to the said order of the 3rd respondent.

Having regard to the above, the 2nd respondent is directed to conduct survey, if not conducted till date, in respect of the property in dispute, and pass appropriate orders in terms of the Order dated 09.12.2015 passed by the 3rd respondent, as early as possible preferably within a period of six (06) weeks from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C. PRAVEEN KUMAR Date:27.10.2016 INL
