This petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, seeking for relaxation of the condition imposed by order dated 19-01-2018 in Criminal M.P.No. 179 of 2018 in Criminal Appeal No. 39 of 2018 on the file of the Court of Metropolitan Sessions Judge, Hyderabad (for short, 'the Court below'), whereby the Court below imposed a condition that the petitioner-appellant shall deposit half of the cheque amount on or before 16-02-2018 while suspending the operation of judgment in C.C.No. 182 of 2016 (Old No. 815 of 2016) on the file of the Court of XXIV Special Magistrate, Hyderabad. 2.

Learned counsel for the petitioner submits that the condition imposed by the Court below is onerous and the petitioner is not in a position to comply with the said condition. 3.

Considering the above, this Court is inclined to modify the condition to the effect that the petitioner shall deposit 35% of the cheque amount within four weeks from today instead of half of the cheque amount on or before 16-02-2018 and the rest of the order shall remain intact.
