Learned counsel for the petitioners says that without following procedure as contemplated under the Telangana Water, Land and Trees Act, 2002, the respondent-authorities seized the bore well of the petitioners situated in their agricultural lands in Sy.No.206 of Peddur Village, Sircilla Mandal, Karimnagar District. As such, the said action of respondent-authorities is in violation of principles of natural justice.
Learned Assistant Government Pleader for revenue on instructions submits that no notice was issued to the petitioners before seizing the bore well. In view of the same, the respondent-authorities are directed to restore the bore well of the petitioners situated in their agricultural lands in Sy.No.206 of Peddur Village, Sircilla Mandal, Karimnagar District. However, this will not preclude the competent authority from taking action in accordance with law. With the above direction, the writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
