This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS) by the petitioner, who is arrayed as accused No.2, in the event of her arrest in connection with FIR No.86 of 2026 of Sathupally Police Station, Khammam District, registered for the offences punishable under Sections 318(4), 319(2),

336(3), 338 r/w 3(5) of the BNS and Section 66-D of the IT Act.

The case of the prosecution is that on 23.02.2026, the de-facto complainant lodged a report before the police stating that Accused Nos.1 to 3 and some other persons cheated him by dishonestly obtaining his bank account details on the pretext of using them for their interior business transactions and GST-related requirements. It is alleged that in the year 2021, Accused No.1 and the present petitioner (Accused No.2) approached the de-facto complainant and requested him to provide bank accounts for their business purposes. The petitioner was a family friend of the complainant, and therefore, believing their representations, the complainant agreed to assist them. Accordingly, the complainant opened two current accounts and provided the account details and access to the accused persons. Subsequently, Accused No.

3 also contacted the complainant and informed him that they were running a payment gateway business under the name "KuberaPe", stating that it was a legal business with proper permissions and that he was conducting the said business along with Accused No.1.

complainant further opened another current account in IDBI Bank, Sathupally and provided the details and access to the accused persons. It is further alleged that the accused persons misused the said bank accounts for illegal activities and forged the credentials of the bank accounts without informing the account holder. Recently, the complainant came to know through newspaper reports that Accused No.1 was involved in a cheating case involving an amount of Rs.547 Crores.

Upon learning about the same, the complainant realized that he had been deceived by the accused persons and that his bank accounts might have been misused without his knowledge or involvement in any illegal activity. Therefore, he lodged the present complaint requesting the police to take necessary legal action against the accused persons. Based on the said complaint, the police registered a case for the above offences. During the course of investigation, based on the confession statement of another accused, the present petitioner was arrayed as Accused No.2, alleging that she was also actively involved in the commission of the offence.. Basing on the confession statement of the other accused person, the petitioner herein is arrayed as

accused No.2 and stated that she is also actively involved in this crime.

Heard Sri T. S. Anirudh Reddy, learned counsel for the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent -State. 4.

The contention of the petitioner is that the petitioner herein is no way connected with the said crime except that she is the wife of accused No.1. It is further contended that the petitioner herein is 8 months pregnant and her expected date for the delivery is 25.05.2026 to 30.05.2026 and because of her health conditions, if she is arrested, her due date for the delivery is 30.05.2026 based on the ultrasound (CRL). Therefore, he requested the Court to grant anticipatory bail to the petitioner on humanitarian ground. 5.

On the other hand, learned Additional Public Prosecutor filed counter denying the averments made by the learned counsel for the petitioner stating that the allegations against the petitioner are serious in nature and the custodial interrogation of the petitioner is required for further

investigation. It is further submitted that, due to the health condition of the petitioner herein, the Court may take decision.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, the petitioner herein is arrayed as accused No.2 and as stated that she is also involved in the said crime along with accused No.1, who is her husband and whereas, the health condition of the petitioner is that she is 8 months pregnant and her due date for the delivery is 30.05.2026. Considering the facts and circumstances of the case and also the health condition of the petitioner herein, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Sathupally Police Station, Khammam District, within two weeks from today, and on such surrender, the said Station House Officer shall release her on bail

on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
