THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6960 of 2015 ORDER:

This criminal petition, under sections 437 & 439 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.3 seeking grant of bail in connection with Crime No.32 of 2015-16 on the file of Excise Police Station, Saroornagar, Ranga Reddy District, registered for the offence under Section 8 (c) read with 22 (c) of the Narcotic Drugs and Psychotropic Substances Act.

The case of the prosecution is that on credible information that A1 is selling the Narcotics in the premises behind D-Mart, Champapet, the Excise Police, Saroornagar, conducted search in the house of A1 on 24.05.2015 and found Alphrazolem and Diazepam material in plastic bags. On enquiry, A1 admitted that he is selling the said material for the purpose of preparing synthetic toddy to sell to the consumers. A1 further confessed that he sold 2 kgs., of Alphrazolem to A3 on the same day morning. Basing on which, the police conducted search in the house of A3 also and seized 5.5 kgs., of Alphrazolem. Hence, the above said crime was registered against A1 to A4.

Heard and perused the material available on record. A perusal of the record discloses that the police seized 27.100 kgs., of raw Alphrazolam and 5.350 kgs., of raw diazepam, which are more than the commercial quantity. Hence, this Court is not inclined to grant bail to the petitioner at this stage.

Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J July 24, 2015.
