The case of the petitioner is that she was issued notice dated 14.03.2017 asking her to handover the subject land for which she was granted patta. Though explanation is filed in pursuant to the said notice, no orders are passed by the respondent authorities. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that without prior notice, the respondent authorities straight away issued impugned notice asking the petitioner to handover the subject property, which is in violation of principles of natural justice. He also submits that petitioner has filed explanation on 27.03.2017 to the said notice. Without passing any orders, the respondent authorities are trying to evict the petitioner from the subject land, though her assignment is subsisting.
Heard the learned Assistant Government Pleader for Revenue.
Though impugned notice is styled as notice, there is a direction asking the petitioner to handover subject land. In view of the same, the 2nd respondent is directed to consider the explanation submitted by the petitioner in pursuant to the notice dated 14.03.2017 and pass orders, after affording an opportunity of hearing to the petitioner. Till passing of orders, no coercive steps shall be taken against the petitioner. If petitioner fails to utilize the opportunity of hearing, it is open for the 2nd
respondent to pass appropriate orders and take action accordingly.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.04.2017 dv
