THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 9928 of 2017 ORDER:

This writ petition is filed challenging the action of the respondents in evicting the petitioners from the land admeasuring Acs.4.15 guntas in Survey Nos.207, 209/A, 209/AA, 210/A, 210/AA and 210/E of Pusugudem Village, Mulkalapalli Mandal, Bhadradri Kothagudem District, pursuant to the order, dated 21.01.2017, passed by respondent No.2 in LTR Case No.15/2016/MKP pending disposal of the appeal preferred by the petitioners before respondent No.1.

This Court while issuing notice before admission, directed the petitioner to take out personal notice to respondent No.5. Though notice was served on respondent No.5, none appeared on his behalf.

Since the relief sought in the present writ petition is with regard to the stay of eviction pending disposal of the appeal before respondent No.1, this Court is inclined to dispose of the writ petition with a direction to respondent No.1 to dispose of the appeal, as expeditiously as possible. Pending disposal of the appeal, the petitioners shall not be evicted from the land in their possession, pursuant to the order passed by respondent No.2 on 21.01.2017. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
