HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL Nos. 1931, 1885, 1886, 1887, 1888 and 1889 of 2005 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Sri B. Narayana Reddy, learned Assistant Solicitor General, at the outset, invited our attention to the relevant documents annexed to the writ petitions to contend that the lease period got over in October, 2008 itself and in view thereof, these appeals have rendered infructuous. Having confronted with this, learned counsel for the appellants, could not and not dispute the submission made by learned Assistant Solicitor General. He further submitted that the issue whether the land where the appellants were asking quarry permission is forest land or not, may be kept open.

We are not passing any such order. It is always open to the appellants to take recourse to the appropriate proceedings for redressal of their grievance, if any. We are making such observation in view of the observation made in the order, dated 28.02.2005, passed by Deputy Director of Mines and Geology, Kakinada, impugned in the writ petitions that "the lease holders can apply afresh for grant of quarry leases by complying with the provisions of Forest (Conservation) Act, 1980".

Writ appeals are disposed of as not pressed with liberty as prayed.

Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
