THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13003 OF 2017 O R D E R :

This Writ Petition is filed seeking a mandamus to declare the action of the respondent authorities in entering the lands of the petitioners for putting stones to lay the road without acquiring the same, as illegal and arbitrary.

The case of the petitioners is that they own and possess various extents of land in Lingayapalem, Rayapudi, Kondamarajupalem Villages of Thullur Mandal, Guntur District. Now, their grievance is that the respondent authorities have been marking their lands for the purpose of laying the road, without acquiring the same and without paying any compensation as mandated under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Heard learned counsel for the petitioners.

Learned Standing Counsel for the 2nd respondent Authority submits that no markings, as alleged by the petitioners, have been made in their lands. If the 2nd respondent Authority requires the lands of the petitioners for laying a road or for any other public purpose, the learned Standing Counsel assures, they would follow the due process of law under the 2013 Act.

Recording the assurance held out by the learned Standing Counsel, the Writ Petition is disposed of directing that if the 2nd respondent Authority requires the lands of the petitioners for

laying a road or for any other public purpose, they shall follow the due process of law under the 2013 Act. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
