FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH THURSDAY, THE TWENTIETH DAY OF JULY TWO THOUSAND AND SIXTEEN
Present
HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.3002 of 2011 Between:
M. Venkateshwar, s/o.Balappa, aged 39 years, occ:Ex-nodel Prerak at Nawabpet, Nawabpet (V)(M), Mahabub Nagar District. .. Petitioner AND The District Collector & Vice Chairman, ZLSS, Mahabub Nagar and others.
.. Respondents
The Court made the following:
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.3002 of 2011
ORDER
Petitioner challenges the order dated 05.08.2010, where-under the third respondent was appointed as Mandal Co-ordinator under Mahatma Gandhi National Rural Employment Guarantee Scheme.
2. Heard learned counsel for the petitioner and learned Government Pleader for Panchayat Raj for respondent No.1 and Sri G. Narender Reddy, learned Standing Counsel for respondent No.2.
3. The only submission that is urged by the learned counsel for the petitioner is that as third respondent is not a native of Gurukunta village and is not a member of Ushodaya Mahila Sangam, he could not have been appointed ignoring the claim of the petitioner.
4. In paragraph No.3 of the counter affidavit filed by respondent No.2, it is specifically averred that respondent No.3 is a resident of Gurukunta Village and is also a member of Ushodaya Mahila Sangam as per the certificates issued by the Mandal Revenue Officer and the President of MMS respectively. This clinches the issue. Even otherwise, as seen
from the order dated 05.08.2010, which is assailed in the writ petition, the appointment was only for one year and that period was already over.
5. Having regard to the same, the Writ Petition is liable to be dismissed and is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
