THE HONOURABLE DR.JUSTICE G. RADHA RANI CRIMINAL PETITION No.3679 of 2024 O R D E R:

This Criminal Petition is filed by the petitioner - A19 under Section 438 of Code of Criminal Procedure for grant of anticipatory bail in the event of his arrest in Crime No.598 of 2021 on the file of Ramachandrapuram Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 419, 420, 406, 467, 468 and 471 of Indian Penal Code, 1860 (for short, 'IPC').

The case of the prosecution in brief was that on 02.08.2021 at 10:00 hours, the Assistant General Manager of Union Bank of India, Punjagutta, Hyderabad lodged a report stating that about 11 accounts dealt by individual borrowers having different properties mortgaged with their Ramachandrapuram Branch had fabricated nala and sale deed documents and mortgaged them as sureties and obtained huge amounts towards business loans and diverted the amounts for their personal use.

Heard the learned counsel for the petitioner-A19 and the learned Additional Public Prosecutor for the respondent - State. 4.

Learned counsel for the petitioner- A19 submitted that this Court granted bail to the petitioners - A15 and A16 vide Criminal Petition Nos.2577 and 2570

Dr.GRR, J crlp_3679_2024 of 2024 respectively on 07.03.2024 and A14 was granted bail vide Criminal Petition No.3115 of 2024 on 21.03.2024, the petitioner also would stand on the same footing as that of A14 to A16 and prayed for grant of anticipatory bail to the petitioner.

Learned Additional Public Prosecutor opposed grant of anticipatory bail to the petitioner.

Considering that this Court granted anticipatory bail to A14 to A16 observing that the Investigating Officer had collected the documents from both the Bank and Revenue Authorities and there was no scope of influencing the witnesses and the present petitioner also stands on the same footing as that of A14 to A16, it is considered fit to grant anticipatory bail to the petitioner - A19 also.

In the result, the Criminal Petition is allowed and the petitioner - A19 is granted anticipatory bail subject to the following conditions: (i) The petitioner - A19 is directed to surrender himself before the Station House Officer of PS Ramachandrapuram, Cyberabad Commissionerate within a period of (15) days from the date of this Order, and on such surrender, the SHO of PS Ramachandrapuram, Cyberabad Commissionerate shall release the petitioner - A19 on bail on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh Only) with two

Dr.GRR, J crlp_3679_2024 sureties for a like sum each to the satisfaction of the said Station House Officer.

(ii) The petitioner - A19 shall comply with the conditions stipulated under Section 438(2) of Cr.P.C.

As a sequel, miscellaneous applications pending in these petitions, if any shall stand closed.
