HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.6501 of 2018 ORDER:

Heard learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondents from the oral instructions and perused the prayer in the writ petition with the supporting affidavit.

The prayer in the writ petition reads as follows: "........to issue a writ, order or direction more particularly one in the nature of Writ of mandamus declaring the highhanded action of the respondents particularly the 3rd respondent and its officials in interfering with construction work which is carrying out by the petitioner vide building permit No.53342/HO/WZ/Cir14/2016 dated 18.09.2017 over land admeasuring 1199 sq. yards (533 + 666.6 sq. yards) under house bearing municipal Nos.4-32-1/233 and 4-32-1/234, on plot nos.233 and 234, under sy.nos.92/2, 93, 94 and 97/2, situated at Sapthagiri Colony, Kukatpally Village and Mandal, Medchal-Malkajgiri District, without following the procedure contemplated under law as illegal, arbitrary unjust and unconstitutional and also in violation of provisions of GHMC Act, 1955, and consequently direct the respondents not to interfere with construction work of the petitioner over the subject property and to pass such other order or orders......"

It is the submission of the learned Standing Counsel that they are inspecting the premises whether the so called construction is going as per the approved plan or not, but not taking the law into their hands. Thereby, the construction if strictly going on as per the approved plan, there will not be any interference from them.

By recording the same, this Writ Petition is disposed of.

Dr. SSRB,J Consequently, miscellaneous petitions, if any shall stand closed. No costs.
