HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
On 11.06.2016, Crime No.98 of 2016 was registered on the complaint given by the 4th respondent alleging that false promise to marry was made by the petitioner and had sexual intercourse with her and later cheated her, and harassed her by suspecting her character. Crime was investigated and charge-sheet was filed. C.C.No.226 of 2016 is pending in the Court of Additional Judicial First Class Magistrate, Jangaon. It appears, case stands posted to 16.04.2019 for examination of accused. This case is filed alleging that 3rd respondent harassing unnecessarily and detained the petitioner in the Police Station every day in the morning from 9.00 a.m., to 10.00 p.m., beat him and also forced him to marry 4th respondent. Petitioner contends that it is no more permissible for Police to harass the petitioner in this manner, affecting his life and liberty.

Learned Government Pleader, on instructions, asserts that since charge-sheet was filed and petitioner is facing trial and no other crime is registered against him, Police are not calling him to the Police Station and making him to sit in the Police Station, and interfering with the life and liberty of petitioner does not arise. 3.
From the averments in paragraph-4 of the affidavit filed in support of Writ Petition, it appears that petitioner is apprehending registration of another crime and in anticipation of such registration, this Writ Petition is filed.

As fairly submitted by learned Government Pleader, on instructions of the Station House Officer, Cherial Police Station, that Police are not interfering with life and liberty of petitioner, and not calling him to Police Station after charge-sheet was filed in Crime No.98 of 2016, the Court is not inclined to entertain the Writ Petition. Leaving it open to petitioner to work out his remedies as and when crime is registered against him, Writ Petition is dismissed.
