THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.13798 of 2017 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondents in constructing the overhead tank in Petitioner's land in and out of survey No. 281/2 to an extent of 0-13 guntas situated at Pandillapalli Village, Chinthakani Mandal, Khammam District by grabbing his land without following due process of Law and without paying any compensation amount to him for the construction of overhead tank in his land, in spite of giving representation dated 25-01-2017 to the respondents No.

2 to 5 requesting them to stop the construction of overhead tank in his land and even after receipt of said representation the respondents did not stop their illegal acts, is illegal, arbitrary, unjust, violation of principles of natural justice and violation of articles 21 and 300-A of the Constitution of India, and consequently direct the respondents to stop the illegal construction of overhead tank in petitioner's land in and out of survey No. 281/2 to an extent of 0-13 guntas situated at Pandillapalli Village, Chinthakani Mandal, Khammam District."

In fact, on 25.01.2017, for redressal of the grievance of the petitioner, the petitioner herein submitted a representation to respondents 2 and 4.

According to the learned counsel for the petitioner, the subject property is a private property acquired by the petitioner herein by way of inheritance from his forefathers and that the petitioner has title deed and pattadar passbooks also for the said

land. It is further stated that in the said land, the respondent are attempting to construct an overhead tank.

Having heard the learned counsel for the petitioner, this Court deems it appropriate to direct respondents 2 and 4 herein to look into the representation, dated 25.01.2017, said to have been submitted by the petitioner herein, and take appropriate action in accordance with law.

With the above observation, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________ A.V.SESHA SAI, J APRIL 24, 2017 YVL
