HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION Nos.6299, 6333, 6367 and 6546 of 2018 COMMON ORDER:

Heard learned counsel for the petitioners, learned Government Pleaders for Fisheries and Revenue for the respondents and perused the prayers in the writ petitions with supporting affidavits, written instructions placed by the learned Government Pleader for Revenue received from the Tahsildar of West Godavari District and the other material on record. 2.

These writ petitions are filed seeking Writ of Mandamus to declare the acts of respondent No.4 in interfering and preventing the petitioners from digging the farm ponds in the lands as per the Certificate Provisional Registrations dated 21.01.2018 issued by respondent No.2 as illegal and arbitrary.

It is stated in the affidavits filed in support of the writ petitions that despite permission accorded by the Fisheries Department by the District Level Committee, provisionally, for digging of tanks, the Revenue Authorities are trying to interfere and preventing the petitioners.

The written instructions placed by the learned Government Pleader for Revenue are clear that the Authorities are not interfering and the said allegations are baseless and if at all there are any violations of G.O.Ms.No.7 and amended G.O.Ms.No.15 dated 26.05.2015, necessary action will be taken.

The learned Government Pleader for Fisheries also submits that since provisional permission already accorded for digging of tanks, the petitioners can dig the tanks without interference. However, they cannot do further acts pending final permission. 6.

Recording the above submissions, these Writ Petitions are disposed of.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
