The Court made the following :

ORDER:

This Company Petition is filed for an order to wind up the respondent for non-payment of debt due to the petitioner.

The case was adjourned from time to time to enable the respondent to settle the dispute with the petitioner. At the hearing, it has come out that the respondent has paid the entire principal amount leaving the interest payable under the decree dated 19-11-2013 in O.S.No.200 of 2010 on the file of the learned XXVII Additional Chief Judge, City Civil Court, Secunderabad.

As the respondent has paid the entire principal amount, I am of the opinion that it is appropriate for the petitioner to approach the civil court for recovery of interest. In this view of the matter, the Company Petition is closed, subject to the liberty given to the petitioner in terms of the observations made above.

As a sequel to the disposal of the Company Petition, Company Application Nos.280 of 2012, 478, 479, 480 and

711 of 2014 are disposed of as infructuous.
