HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.45477 of 2016

ORDER

This writ petition is filed seeking to declare the inaction of the 2nd respondent in commencing the investigation in Cr.No.129 of 2015, registered on 7.11.2015 by the Station House Officer, Cherukupalli Police Station, Guntur District, as arbitrary and illegal.

Learned Government Pleader, on written instructions, submits that the petitioner is not residing within the limits of Cherukupalli Police Station and that when the police tried to examine and record the statement of the petitioner over phone, it was unreachable. Hence, a notice under Section 91 Cr.P.C. was sent to the petitioner's address directing her to produce the documents and witnesses for proceeding with further investigation. Though the petitioner acknowledged receipt of the said notice, so far she did not approach the police and hence the investigation is pending. In view of the said instructions of the learned Government Pleader, liberty is given to the petitioner to approach the police concerned, who are investigating the crime and co-operate with the investigation. Subject to the co-operation, the Cherukupalli Police are directed to complete

the investigation and file a final report, as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
