HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7421 OF 2015 O R D E R :
This petition is filed for a writ of Mandamus declaring the action of respondent No.4 in not implementing the order of this Court in W.P.No.11558 of 2014 and making construction of house as illegal, arbitrary and violative of Articles 14, 21 of the Constitution of India and contravention of the Municipal Corporation Act and consequently to direct respondents 1 to 3 not to grant any permission or regularize the illegal construction of respondent No.4.
Heard the learned counsel for the petitioner and Sri R.Radha Krishna Reddy, learned Standing Counsel, appearing for respondent No.1-Greater Hyderabad Municipal Corporation.
When the matter is taken up for hearing, it is brought to the notice of this Court that the petitioner already filed W.P.No.11558 of 2014 for the self-same relief and this Court disposed of the same on 27.01.2015 directing the 4th respondent not to make any construction without obtaining valid permission from the respondent Corporation-GHMC.
The learned counsel for the petitioner submits that since the respondents are not taking any action, the present writ petition is filed. Learned Standing Counsel submits that when once the writ petition is disposed of with certain directions, the petitioner cannot maintain another petition for the self same relief.
In view of the same, this writ petition is misconceived and the same is dismissed. However, it is open to the petitioner to take appropriate steps, if the order of this Court is not implemented. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________
