Petitioner claims to be the owner of agricultural land to an extent of Ac.3.18 guntas in Sy.No.853/28 of Dammakkapeta village, Hamlet of Ramanujavaram, Manuguru Mandal, BhadradriKothagudem district. According to the petitioner, she belongs to Scheduled Tribe and land is located within the notified scheduled area. While so, proceedings were initiated against the petitioner under Andhra Pradesh Land Encroachment Act, 1905 and the Tahsildar, Manuguru, passed orders on 04.01.2015 holding that petitioner is encroacher of the Government land and ordered for eviction of petitioner from encroachment of Government land. Aggrieved thereby, petitioner filed appeal before the Revenue Divisional Officer. Alleging in action on the appeal preferred by the petitioner, this writ petition is filed.

Learned Government Pleader, on instructions, submits that the appeal preferred by the petitioner is numbered as C/2/Mgnr/2017 and the Revenue Divisional Officer fixed 11.09.2017 as date of hearing.

In view of the same, writ petition is disposed of. Petitioner shall appear before the Revenue Divisional Officer on 11.09.2017 and make his submissions and also present all relevant documents in support of his version before the Revenue Divisional Officer. On consideration of the documents, if any, filed on behalf of the petitioner, the Revenue Divisional Officer shall consider and pass orders duly assigning reasons in support of his decision. He shall

pass order and communicate the same to the petitioner within a period of six weeks after completing the hearing. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
