HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24680 OF 2006 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioners, to declare the action of the respondent in not considering the recommendations cum required verification reports of the State Government through letters, dated 22.04.1994 and 25.03.1994, for grant of Central Freedom Fighter Pension for their participation in the Hyderabad Liberation Movement under Swatantra Sainik Samman Pension Scheme, 1980, as arbitrary and illegal and consequently, direct the respondent to consider the cases of the petitioners for grant of Central Freedom Fighter Pension under the said scheme.

The case of the petitioners is that they are all freedom fighters participated in Hyderabad Liberation Movement.

They made applications for sanction of Central Freedom Fighter pension under Swatantra Sainik Samman Pension Scheme-1980. The Government of A.P. also forwarded their applications in letter Nos.14001/F.F.II/94-2, dated 22.04.1994, Lr.No.13994/FF.II/94, dated 25.03.1994 and Lr.No.13996/FF.II/94, dated 25.03.1994, respectively, along with all necessary documents, to the respondent. Since more than 12 1⁄2 years the applications of the petitioners are pending consideration with the respondent. All the petitioners are aged more than 76 years. They also made several representations to the respondent, but there was no response. Hence, they filed the present writ petition. No counter affidavit is filed by the respondent. Considering the facts and circumstances of the case, the respondent is directed to consider the applications of the petitioners, which were submitted in the year 1994, along with the

recommendations of the Government of A.P., and pass orders in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
