THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8107 of 2016 ORDER:
This Criminal Petition is filed by the petitioners-A3 & A8 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to them in Crime No.44 of 2016 on the file of Peddamul Police Station, Ranga Reddy District, registered for the offence punishable under Section 302 IPC.
Heard and perused the material available on record. The allegation against the petitioners is that they killed the adopted son of the de facto complainant by causing injury on his head with a country made weapon.
Learned counsel for the petitioners submitted that the petitioners are innocent of the offence alleged against them and that they were remanded to judicial custody on 17.05.2016 and 19.05.2016 respectively, and most part of the investigation is also completed, and hence, they may be granted bail.
Learned Additional Public Prosecutor submitted that there are specific overt acts against the petitioners and the investigation is still pending and it is too early to grant bail to the petitioners, and therefore, this petition may be dismissed.
Considering the facts and circumstances of the case and also taking into consideration the submissions of the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioners.
Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J June 17, 2016.
