Heard Sri T.B.B.Krishna Mohan for petitioner and Sri M.Ravinder for respondents.

The petitioner challenges provisional assessment Lr.No.ADE/ O/ / F.No./ D.No.631, dated 31.05.2016 as illegal and arbitrary.

Admittedly, the petitioner challenges provisional assessment notice and he paid an amount of Rs.1,02,000/ -. The issue is substantially pending before respondents 3 and 4. It appears the present writ petition is filed apprehending disconnection of power supply pending consideration and passing of final orders by respondents 3 and 4.

This Court is satisfied that the writ petition can be disposed of by this order.

(a) The petitioner is directed to deposit a further sum of Rs.5,87,835/ - (Rupees five lakhs eighty seven thousand eight hundred and thirty five only) within four weeks from today.

(b) Respondents 3 and 4 are directed to consider the case of petitioner and pass orders and if circumstances warrant, consider referring the matter to the Special Court for adjudication.

(c ) Till a decision on final assessment is taken and communicated, the power supply shall not be disconnected.

(d ) The above exercise is directed to be completed within 12 weeks from today.

The writ petition is disposed of accordingly. No order as to costs.
