SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2411 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is sole accused, in Crime No.97 of 2017 on the file of V.Madugula Police Station, Visakhapatnam District. The offences alleged are under Section 20(b)(1)(c) r/w 8(c) of NDPS Act. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, 60Kgs of Ganza was seized from a car and the driver of the car stopped the vehicle and absconded from the place and he was immediately identified as one Matta Srinivas Rao. The counsel for petitioner submits that this petitioner was arrested only subsequently and that the identification made is not proper. But, the public prosecutor submits that, the vehicle in which Ganza was found, stands in the name of the wife of the petitioner.

Hence, in the above circumstances, the identification made by the people present there, with regard to the petitioner, seems to be convincing.

Hence, considering the above, this court opines that it is not a fit case for grant of anticipatory bail.

Accordingly, this criminal petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
