HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 31042 of 2017 Order:

The petitioner is Upa-Sarpanch of Gattu Village and Mandal, Jogulamba Gadwal District. He filed the present Writ Petition challenging the notice issued by the fourth respondent under purported exercise of power under Section 245(2) of Telangana Panchayat Raj Act proposing to conduct a meeting of 'No Confidence' on 16.09.2017. The petitioner states that no copy of the resolution or intention to move 'No Confidence Motion' was enclosed to the notice and it is also contended that the fourth respondent has no jurisdiction to issue the notice. He raised several other contentions. However, learned Government Pleader, at the time of taking up the matter for consideration, fairly conceded that the notice issued by the fourth respondent is irregular and the District Collector instructed him to withdraw the notice.

In view of the same, the Writ Petition is allowed and the impugned notice is set aside. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
