THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24172 of 2009 ORDER:

Heard learned counsel appearing for parties.

The petitioner complains against inaction of respondents in considering and disposing of representation, dated 19-11-2008 made for issuing Service Certificate in the post of the Assistant Sub-Inspector as illegal, arbitrary and unconstitutional. The respondent filed counter affidavit and appended annexures contending that the very representation is not maintainable and there is no inaction.

With the assistance of the learned Standing counsel appearing for the respondent, I have perused the stand taken in the counter affidavit and also the annexures. This court is of the view that the stand taken in the counter affidavit does not show that the representation in fact is considered and any communication is sent to the petitioner. On the other hand, the counter affidavit tries to show that the petitioner is not entitled for issuing Service Certificate as requested by petitioner through his representation dated 19-11-2008.

I have perused the material available on record and noted the limited grievance of petitioner.

Learned Standing Counsel after taking note of limited grievance in the writ prayer submits that the respondent will consider and dispose of the representation dated 19-11-2008 within a period of three months from the date of receipt of a copy

of this order.

The statement is placed on record.

It is made clear that this Court is not expressing its view on the merits of the matter. The respondent considers and disposes of the representation in accordance with law within three months from the date of receipt of a copy of this order and communicates the same to the petitioner.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
