THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5538 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ in the nature of a Writ of Mandamus or any other appropriate writ direction or order declaring the in action of the 2nd respondent in processing application of the petitioner to avail open accesses for the month of February, 2017 and not granting No Objection Certificate/ Standing Clearance to the petitioner as wholly arbitrary, illegal, without jurisdiction and void and contrary to the Andhra Pradesh Electricity Regulatory Commission (Terms and Conditions of Open Access to Infra-State Transmission and Distribution Network) Regulations (Regulation 2 of 2005) and violative of Article 14 and 19(1)(g) of the Constitution of India and consequently direct the 2nd respondent to issue 'No Objection Certificate'/ Standing Clearance to the petitioner for the month of February, 2017 in pursuant to its application dt.26.1.2017 and further months."

Heard the learned counsel for the petitioner and Sri R.Vinod Reddy, learned standing counsel for the respondents. 3.

It is submitted by the learned counsel for the petitioner that for availing open access for the month of February, 2017, the petitioner herein made an application to the 2nd

AVSS,J W.P.No.5538 of 2017 respondent on 26.01.2017 and no action has been taken on the said application. It is submitted by the learned standing counsel that the same will be considered as per law. 4.

Recording the said submission, this writ petition is disposed of, directing the 2nd respondent to process the application of the petitioner dated 26.01.2017, as per law, within a period of one week from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
