THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8135 OF 2016 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.1 and A.3 seeking bail in crime No.8 of 2016 on the file of the P.S., Maredumilli, East Godavari District, registered for the offence under Section 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused.

The allegation against the petitioners herein is that the petitioners herein along with another accused were found in illegal possession of 80 kgs., of Ganja.

Learned counsel for the petitioners submits that the petitioners have not committed any offence and that they have been falsely implicated in the present case. He prays this Court to grant bail to the petitioners.

Earlier bail application of the petitioners was dismissed by this Court on 23.03.2016 and that there is no change of circumstances. Further, the quantity of Ganja, which was found in possession of petitioners is commercial quantity and also as there is a bar to grant bail in case of commercial quantity, this Court is not inclined to grant bail to the petitioners/A.1 and A.3.
