THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10566 of 2012 ORDER:

This Writ Petition was filed challenging the inaction of the second respondent in taking action against the construction made by the third respondent over plot bearing MPL No.5-7-637 situated in front of Tilak Garden, Nizamabad, in spite of the representation of the petitioner dated 17.03.2012.

The third respondent is the neighbour to the petitioner, and when he was making construction contrary to the sanctioned plan, the petitioner submitted a representation on 17.03.2012 and when the same was not considered, the present Writ Petition was filed. Even after four years, no counter affidavit is filed by the second respondent. In spite of giving opportunity to the petitioner, the petitioner could not serve notice on the third respondent. In the circumstances, in view of the relief sought in the Writ Petition, this Court is not inclined to keep the Writ Petition pending. The Writ Petition is, therefore, disposed of directing the second respondent to consider the representation of the petitioner dated 17.03.2012 and pass appropriate orders in accordance with law by giving due opportunity to the petitioner as well as to the third respondent. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
