THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.27073 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the fourth respondent in failing to take action on the applications filed by the petitioner on 06.09.2013, 30.12.2015, 18.02.2017 and 06.03.2017 for mutation of his name in revenue records and for grant of pattedar pass books and title deeds, as illegal and arbitrary. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.

The main grievance of the petitioner in this writ petition is that though he submitted an application for mutation of his name in revenue records, in pursuance of the will deed dated 10.10.2009 in respect of lands admeasuring Acs.10.11 guntas, Acs.3.04 guntas, Acs.8.20 guntas, Ac.0.05 guntas, Ac.0.27 guntas, Acs.2.01 guntas and Acs.6.30 guntas covered by survey Nos.8, 5/A, 33/A, 2, 19, 18 & 17 of Thatipally Village, Sirikonda Mandal, Nizamabad District, no orders are passed thereon till date.

Learned AGP would submit that the fourth respondent may be directed to consider the application dated 06.03.2017, provided the petitioner paid the requisite fee and if the application is in order. Having regard to the rival submissions made, without going into the merits of the case, the Writ Petition is disposed of directing the fourth respondent-Tahasildar to deal with the application

submitted by the petitioner on 06.03.2017 seeking mutation of his name in revenue records in respect of subject lands, provided the same is in order, in accordance with law, as early as possible, preferably within a period of six weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
