Md. Sameer v. The State Of Telangana Rep By Its Principal Secretary
HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.317 of 2017
ORDER
This writ petition is filed challenging registration of Cr.No.590 of 2016, dated 25.12.2016 against the petitioners pursuant to a complaint lodged by the 3rd respondent. Though notice was served, none appeared on behalf of the 3rd respondent.
A reading of the complaint discloses a prima facie case for registration of crime and investigation is in progress. So far as registration of crime under the provisions of Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989 is concerned, the same requires further enquiry.
In the circumstances, this Court is not inclined to interfere with registration of crime. However, the 2nd respondent is directed to continue the investigation without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 22nd January, 2017 rkk
