HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.25604 of 2008 ORDER:

The petitioners complain against inaction of respondents 1 to 3 in examining and taking action on the representation dated 16.07.2008 of petitioners, as illegal, arbitrary and amounts to refusing to exercise jurisdiction conferred on respondents by the A.P. Cooperative Societies Act.

2. The 3rd respondent filed counter-affidavit dated 05.02.2009 setting out the totality of the circumstances which prevail in 4th respondent-society. The counter-affidavit, to some extent, takes note of irregularities and illegalities warranting enquiry and necessary action by respondents 1 to 3.

3. Learned Government Pleader (Cooperation) places on record the communication dated 04.12.2009 addressed to the Vigilance Commissioner, Andhra Pradesh Secretariat in Rc.No.1219/ 2010-NC2 dated 04.11.2010 by the Joint Registrar, Kurnool, Office Note dated 15.10.2012, Letter in Rc.No.253/ 2012 dated 14.12.2012 of the Assistant Registrar, Sub Divisional Co-op. Officer, Kurnool addressed to the Station House Officer, III Town PS, Kurnool, proceedings of the Divisional Cooperative Officer, Kurnool in Rc.No.781/ 2010-C1 dated 13.12.2013, Lr. in Rc.No.1219/ 2010-NC2 dated 22.01.2014 of the District Collector, Kurnool to the Deputy Inspector General of Stamps and Registration, Kurnool etc. and submits that the enquiry part into irregularities is completed and the consequential steps as required pursuant to communication dated 22.01.2014 of the District Collector will be

completed within two months from the date of receipt of a copy of this order.

4. The statement made by the learned Government Pleader on behalf of the 2nd respondent is placed on record and accepted. Hence, with the consequent of learned counsel appearing for the parties, the writ petition is disposed of by this order:

(a) The respondents 1 to 3 are directed to take all steps necessary to complete the decision taken in this behalf within two (2) months from the date of receipt of a copy of this order by referring to the correspondence placed on record by 2nd respondent.

(b) The petitioners are also given liberty to submit a copy of this order by filing a memo before the respondents 1 to 3 for timely decision.

5. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
