THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8934 of 2017 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed to quash the proceedings in C.C.No.53 of 2016 on the file of Principal Judicial First Class Magistrate at Mancherial, on various grounds. During hearing, Sri N. Indrasena Reddy, learned counsel for the petitioner, submitted that the petitioner appeared before the Court on receipt of summons, but on 1.05.2017, he failed to appear before the Court and therefore, the trial Court issued NBW against the petitioner, which is pending for execution, and requested this Court to give necessary direction to the concerned Magistrate to dispose of the application, if any, filed by the petitioner, under Section 70(2) Cr.P.C. In view of the request made by the learned counsel for the petitioner, I deem it appropriate to direct the concerned Magistrate to decide the application, if any, filed by the petitioner under Section 70(2) Cr.P.C., for recall of NBW issued against the petitioner, after serving notice on the complainant, on the same day, in accordance with law.

With the above direction, this Criminal Petition is disposed of. Consequently, miscellaneous applications pending, if any, shall also stand dismissed.
