HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.21250 of 2011 ORDER:

Neither is Sri M. Kalyana Rama Krishna, Learned Counsel for the petitioner present nor is there any representation on his behalf. The relief sought for in this Writ Petition is for a mandamus to declare the change of billing Category III to billing Category II below 75 HP, as per the respondent's tariff orders of 2011-2012 vide letter dated 07.07.2011, as arbitrary and unconstitutional. By the proceedings dated 07.07.2011, the respondent informed that the printing press must be billed in Category II as per tariff order 2011-2012, and not under Category III. While the change in the category was questioned by way of the present Writ Petition in the year 2011, no interim order was passed therein. Consequently the Tariff Order, for the year 2011-12, was applied. Sri R.

Vinod Reddy, Learned Standing Counsel would submit that the amounts payable, in terms of the said Tariff Order, must have been recovered from the petitioner. I see no reason at this length of time, since nearly seven years have elapsed, to interfere with the order impugned in the Writ Petition. The Writ Petition fails and is, accordingly, dismissed.
