HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL Nos. 627 and 660 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Admittedly, the respondent-institution/college did not allow the Inspection Team to conduct re-inspection in terms of the order, dated 23.09.2015. As a matter of fact, the institution addressed a letter, dated 08.12.2015, to the Registrar of University clearly stating therein that "due to unforeseen circumstances in procuring the lab equipment and getting the required faculty, we could not comply with our earlier assurance given to the Hon'ble Court.

We submit that the deficiencies pointed out by the JNTUH/AICTE on earlier occasion have not been rectified as yet. As such we want to withdraw our case with respect to TSPGECET-2015 admissions before the Hon'ble Court and seeking direction to the University not to carry out FFC inspection."

At the request of learned counsel for the respondentinstitution/college, the students admitted for B.Tech (CSE) and B.Tech (ECE) in the college in W.A.No.660 of 2015 and B.Tech (ECE) and B.Tech (Mechanical) in the college in W.A.No.627 of 2015 are directed to be transferred and accommodated in other recognised institution/college within a period of two weeks from today.

Learned Advocate General for the State of Telangana submits that the students admitted in the College in W.A.No.660 of 2015 under management quota shall also be transferred and accommodated to other recognised institution/college within a period of two weeks from today. His statement is recorded and accepted. In view thereof, the students under the Convenor quota are directed to approach the Convenor within a period of ten days from today. The Convenor is directed to accommodate/transfer those students in other recognised institution/college for the same courses within a period of two weeks therefrom. Insofar as the students under management quota are concerned, they are directed to approach the Registrar of University within a period of ten days from today.

The Registrar of University shall accommodate/transfer those students in other recognised institution/college within a period of two weeks therefrom. The respondent institution/college is directed to refund fees collected from these students within a period of two weeks from today. Admission of these students in other institution/college would be subject to fee adjustment, if any.

In view thereof, the writ appeals filed by the University insofar as the respondent-institution/colleges are concerned deserve to be allowed and the order impugned in the writ appeals also deserves to be set aside insofar as respondent-institution is concerned. Order accordingly.

Consequently, miscellaneous petitions, if any, also stand disposed of.
