ORDER

This contempt case is filed complaining wilful disobedience on the part of the respondents in implementing the order dated 25.04.2017 passed by this Court in W.P.M.P.No.18482 of 2017 in W.P.No.14954 of 2017. W.P.No.14954 of 2017 is filed challenging the impugned letters dated 13.11.2015 & 23.11.2015 issued by the 4th respondent rejecting the BPS applications of the petitioners in relation to the lands in Sy.No.318/1, on the ground that certain proceedings arising out of the order of the Land Grabbing Court in respect of the said survey number, are pending. The petitioners in the writ petition were added as respondents 75 and 76 vide order dated 14.6.2016 in W.P.M.P.No.52094 of 2015 in W.P.No.16789 of 2011, wherein the proceedings of C.G.C.No.54 of 2008 came to be challenged.

While admitting the writ petition, this Court on 25.4.2017 in WPMP No.18482 of 2017, suspended the impugned letters dated 13.11.2015 & 23.11.2015 and directed the petitioners not to make any further constructions in the subject property.

Learned counsel appearing for the petitioner submits that on account of pendency of the matters, the application of the petitioner and another for regularization under Building Penalization Scheme could not be processed.

It appears that the petitioners applications came to be rejected on 13.11.2015 & 23.11.2015 itself and the said rejection orders were challenged in the writ petition. This Court, vide order dated 25.4.2017, suspended the impugned letters. While suspending the impugned letters, no direction was given to the respondents to process the application of the petitioners for regularization. Hence, it cannot be said that the respondents have violated the orders passed by this Court on 25.4.2017 in WPMP No.18482 of 2017 in W.P.No.14954 of 2017. Accordingly, the Contempt Case is closed.

Miscellaneous petitions, if any, pending shall stand closed.
