THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6492 of 2018 ORDER:

In this Writ Petition, petitioner seeks to issue a direction to the third respondent - Secretary, Gram Panchayat, Venkatapuram, Bhupalapally-Jayashankar District, to consider his representation, dated 27.04.2017.

In the writ affidavit, the petitioner states that he is the owner of house bearing Door No.5-111 in Survey No.69/2 situated in Venkatapuram Village and Mandal, BhupalapallyJayashankar District; that the land in Survey No.69/2 is a part of Nugur Mahal; that in 1973, the Settlement Officer, Rajahmundry, has taken up Case No.3816 for grant of ryotwari patta and the same was disposed of on 26.12.1973; that subsequently, in 2002, the Mandal Revenue Officer, Venkatapuram, conducted survey of the land and found that the petitioner is in possession and enjoyment of the same; that in 2011, one Gade Nageswara Rao filed O.S.No.80 of 2011 in the Court of Sub-Divisional Magistrate, Mobile Court, Bhadrachalam, for perpetual injunction and the said suit was dismissed on 12.04.2013; that the said judgment had become final as there was no appeal preferred against the same; that taking advantage of the wrong entries in the panchayat records, the said Gade Nageswara Rao is creating

CKR, J W.P.No.6492 of 2018 litigation and therefore, the petitioner submitted a representation on 27.04.2017 to the third respondent seeking to change the ownership details in the panchayat records. In spite of the same, no action is being taken thereon.

Heard learned Standing Counsel for Venkatapuram Gram Panchayat appearing for the third respondent. The nature of relief, which the petitioner is seeking, is only to issue directions to the third respondent to consider his representation, dated 27.04.2017.

In those circumstances, the Writ Petition is disposed of with the direction to the third respondent to consider the representation of the petitioner dated 27.04.2017 by taking into account the material, if any, produced by him, and pass appropriate orders within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that this Court had not expressed any opinion with respect to the claim of the petitioner.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
