THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4494 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.778 of 2007 on the file of the Court of the III Metropolitan Magistrate, Vijayawada, arising out of offences under Sections 419, 420, 464, 467, 468, 471 and 120-B IPC.

Heard and perused the material available on record. This Court is of the view that truth or otherwise of the allegations made against the petitioners can be decided only after due trial. Further, though the charge sheet was filed in 2005, the present criminal petition seeking to quash the same in 2016 belatedly, which is unexplained. Hence, this Court is not inclined to interfere with the proceedings against the petitioners.

The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 31.03.2016 pln
