Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for respondents 1 to 3.

Aggrieved by the decision of the Tahsildar, Mahabubnagar District, in mutating the names of unofficial respondents in the revenue records concerning the lands claimed by the petitioners as belonging to them, they filed appeal before the Revenue Divisional Officer, Mahabubnagar District, under Section 5 (5) of the Andhra Pradesh Rights in Land and Pattadar and Passbooks Act, 1971. Alleging that the appeal is kept pending for long time without any justification, this Writ Petition is filed. 3.

The Revenue Divisional Officer, Mahabubnagar District, assigned Appeal No.1430 of 2018 to the appeal preferred by the petitioners. It appears, the appeal is pending before the Revenue Divisional Officer.

Having regard to the same, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the Revenue Divisional Officer, Mahabubnagar District, to consider and pass appropriate orders on the appeal, if pending before him, by affording due opportunity to both parties and assigning reasons in support of his decision and communicate the same to the petitioners within a period of three months from

- 3 - the date of receipt of a copy of the order. Pending miscellaneous petitions, if any, shall stand closed.
