THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36836 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the inaction on the part of the respondents 2 and 3 in not registering the F.I.R., and causing investigation on the complaints, dated 29.04.2016 and 01.09.2016, by the petitioner company to the respondents, as illegal and arbitrary, and consequently, to direct the respondents 2 and 3 to register the F.I.R., and investigate into the complaints dated 29.04.2016 and 01.09.2016 given by the petitioner.

Heard and perused the material.

Learned counsel for the petitioner submits that though the petitioner lodged complaints, dated 29.04.2016 and 01.09.2016, the respondents 2 and 3 are not registering the complaints and as such, he prays this Court to direct the respondents 2 and 3 to register the complaints and take action against the fourth respondent. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the respondents 2 and 3 to register the complaint of the petitioner, if it discloses any cognizable offence and conduct effective investigation and file final report, if any, in accordance with law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 31.10.2016 pln
