HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3824 OF 2017 ORDER:
The case of the petitioner is that petitioner's husband was assigned an extent of Ac.10-00 agricultural land in Sy.No.225/3 of Kothagattu Village and out of the same Ac.2-17 guntas was acquired through notification dated 11.11.1985 by the Irrigation Department for Sreeram Sagar Canal. After the demise of her husband, the petitioner made a representation on 25.06.2015 for mutation of her name in the revenue records in respect of the subject property. But the same is not being disposed of. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue submits that petitioner has to make necessary application in Form VI-A as per the provisions of A.P.Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act') for mutation of her name in the revenue records.
Learned counsel for the petitioner submits that the petitioner will make necessary application as per the provisions of the Act.
In view of the above facts and circumstances, without expressing any opinion on merits, this writ petition is disposed of leaving it open to the petitioner to make necessary application as per the provisions of the Act and on such application being filed by the petitioner, the 4th respondent is directed to dispose of the same in accordance with law. It is stated that names of the third
parties were entered in the revenue records without any basis. The 4th respondent shall consider this fact while disposing of the application of the petitioner. There shall be no order as to costs.
