HONOURABLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.14900 of 2017 ORDER:
This Writ Petition is filed for the following relief: " To issue a writ in the nature of Mandamus or an appropriate Writ or order or direction to the Respondents herein holding that the action on the part of the Respondent in not paying statutory Exgratia as departmental policy of APSPDCL, Tirupathi issued in S.0.0 (CGM-HRD) Rt.No. 761, dated 26-102013 read with the orders of the A.P.Electricity Regulatory Commission, Hyderabad issued in proceeding No. APERC/ Secy / EA S/ S-101/ 177/ 2013, dated 13-08-2013 even after lapse of more than three years is illegal, arbitrary and violation of fundamental rights guaranteed under the constitution and direct the Respondent to pay exgratia of Rs.2,00,000/ - (Rupees Two Lakhs only) to the Petitioner herein for the death of her husband due to Electric shock with in a time bound period." Heard Sri P. Raghavendra Rao, learned counsel for petitioner and Sri Jagarlamudi Koteswari Devi, learned Standing Counsel for the respondents.
According to the petitioner her husband one Bondala Lurdhaiah S/ o.Balaswamy, who was an agricultural labourer, while wetting the paddy crop on 30.11.2013, met with a fatal electrical accident which resulted in his death instantaneously due to electric shock. It is submitted that the petitioner herein is entitled for the benefits under the order issued vide proceedings No.S.O.O.(CGM-HRD) Rt.No.761, dated 26.10.2013, issued by the respondents.
Learned counsel for the petitioner submitted that the petitioner submitted representation dated 13.02.2017 for redressal of her grievance, but no action has been taken by the respondents so far on the said representation.
Having heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents, this Court deems it appropriate to direct the respondents to consider representation dated 13.02.2017 said to have been submitted by the petitioner and take appropriate action in accordance with law.
Accordingly, the Writ Petition is disposed of directing the respondents to consider representation dated 13.02.2017, said to have been submitted by the petitioner, and take appropriate action in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order. No costs. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
