Heard.

The petitioner herein, who is a complainant in FIR No.23 of 2012, has filed this writ petition alleging that the investigation is not being conducted in spite of FIR being registered as early as on 20-042012. Learned Government Pleader has received instructions, which state that after registration of the aforesaid crime, investigation is taken up and the investigating officer has already recorded the statements of three witnesses and the material objects i.e., LG Company black colour cell phone with Airtel SIM and Samsung Company white colour cell phone with Airtel SIM were also seized from the suspected persons. It is also stated that the material objects were sent to FSL authorities for analysis on 13-07-2012 and the report is awaited. It is stated that the investigation is almost completed and as soon as the report from FSL authorities is received, appropriate report under Section 173 Cr.P.C. would be filed expeditiously. It is further stated that the delay has occurred on account of change of Investigating Officers.

In view of the above, therefore, the writ petition is disposed of directing the 3rd respondent to take all necessary steps, after receipt of FSL report and file appropriate report expeditiously. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
