Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration for respondent No.1 and Sri Md. Saleem, learned Standing Counsel for respondent Nos.2 & 3 from the oral instructions and perused the prayer in the writ petition with the supporting affidavit.

The prayer in the writ petition reads as follows: "........to issue appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the Respondents No.2 and 3 trying to demolish the petitioner Cool Drink shop situated in D.No.7-163, P.V.Road Near RTC Bus Stand, Srikahalasti Town, Chittoor District, as arbitrary illegal against Articles 19 and 21 of the Constitution of India in the interest of justice and pass such other order or orders......" It is the submission of the learned Standing Counsel that they are acting as per the procedure contemplated by Section 192 of the Municipalities Act, 1965 so far as the encroachment of the road side area by the petitioner concerned.

By recording the same, this Writ Petition is disposed of. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
